End User License Agreement

This End User License Agreement (“Agreement”) is a legal agreement between you and Motecraft Studio (“Motecraft”, “we”, “us”), a studio based in Ahmedabad, India, governing your use of the Motecraft mobile applications for iOS and Android and any content, updates, and in-app purchases within them (together, the “App”). By downloading, installing, or using the App, you agree to this Agreement. If you do not agree, do not use the App.

1. This agreement is with us, not Apple

This Agreement is between you and Motecraft only, and not with Apple Inc. On iOS and iPadOS, the App is licensed, not sold, to you for use only under the terms of this Agreement and Apple’s Licensed Application End User License Agreement (“Apple Standard EULA”). Where this Agreement is silent, the Apple Standard EULA applies; where the two conflict for iOS use, the terms more protective of you govern. Motecraft, not Apple, is solely responsible for the App and its content.

2. Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the App on any Apple-branded or Android device that you own or control, for your own personal, non-commercial enjoyment, subject to the applicable app store’s usage rules. This licence does not permit you to install or use the App on a device you do not own or control, except as permitted by those usage rules (e.g. Family Sharing).

3. Things you agree not to do

You agree not to copy (except as expressly permitted), modify, adapt, translate, reverse-engineer, decompile, or disassemble the App; create derivative works from it; rent, lease, lend, sell, redistribute, or sublicense it; remove any proprietary notices; or use it in any unlawful way or in a way that could damage, disable, or impair our services.

4. The free collection and Motecraft Pro

A large collection of experiences is available free of charge and remains free. Some experiences and features (“Premium Content”) require Motecraft Pro, purchased as an in-app purchase.

Motecraft Pro is offered in these forms:

  • Lifetime — a one-time, non-consumable purchase that unlocks Premium Content for the life of the App. It is not a subscription and does not auto-renew.
  • Annual and Monthly — auto-renewable subscriptions that unlock Premium Content for the subscription period. An introductory free trial may be offered on the annual plan to new subscribers.

5. Billing, renewal, and cancellation

All purchases are processed by the app store through which you obtained the App (the Apple App Store or Google Play), not by us. Prices are shown in the App before you buy and vary by region.

For auto-renewable subscriptions:

  • Payment is charged to your Apple Account (iOS) or Google Play account (Android) at confirmation of purchase.
  • The subscription renews automatically for the same period at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours before the end of the current period.
  • You can manage or cancel your subscription, and turn off auto-renew, in your Apple Account or Google Play account settings after purchase. Cancelling stops future renewals; the current period continues until it ends.
  • If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.

Refunds. All purchases are final except where required by law or by the app store’s policies. Refund requests are handled by the app store (Apple or Google), not by Motecraft, in accordance with their terms.

6. Sign-in and restoring your purchase

You do not need an account to use the free App. To carry a Motecraft Pro entitlement across your devices — including between iOS, iPadOS, and Android — you may sign in with Apple or with your email address. We use that sign-in only to associate and restore your purchase; see our Privacy Policy for how sign-in data is handled. You can also restore purchases on a new device using the app store’s “Restore Purchases” feature.

7. Your content

If the App lets you capture or export images or recordings of an experience, those creations are yours to keep and use. You are responsible for how you use them.

8. Maintenance and support

Motecraft is solely responsible for providing any maintenance and support services for the App. Apple has no obligation to furnish any maintenance or support. For help, contact us at support@motecraftstudio.com.

9. Warranty and disclaimer

The App is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are our sole responsibility.

10. Product claims

Motecraft, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession and/or use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.

11. Intellectual property

The App, its visuals, code, and design are owned by Motecraft and protected by intellectual-property laws. In the event of a third-party claim that the App or your possession and use of it infringes that third party’s intellectual-property rights, Motecraft, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of any such claim.

12. Legal compliance

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable laws in using the App.

13. Third-party services

The App uses third-party services, including Google Firebase (analytics, crash reporting, configuration) and RevenueCat (purchase management). Your use of the App may be subject to those third parties’ terms, and you agree to comply with them. Those third parties are not responsible for the App.

14. Apple as third-party beneficiary

You acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.

15. Termination

This Agreement is effective until terminated. Your rights under it end automatically if you fail to comply with any of its terms. Upon termination, you must stop using the App and delete all copies. Provisions that by their nature should survive termination will survive.

16. Changes

We may update this Agreement from time to time. When we do, we will revise the “Last updated” date above and post the new version here. Your continued use of the App after a change takes effect constitutes acceptance of the revised Agreement.

17. Governing law

This Agreement is governed by the laws of India, without regard to conflict-of-law principles, and the courts at Ahmedabad, Gujarat, India will have jurisdiction, except where the mandatory consumer-protection laws of your country of residence provide otherwise.
